Copyright and DMCA Policy

Graniite respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512, we respond to clear notices of alleged copyright infringement involving material stored on Graniite at the direction of a user or made accessible through a Graniite share link.

This policy explains how to report infringement, how an affected user can respond, and how we handle repeat infringers.

1. Reporting alleged infringement

If you believe content available through Graniite infringes a copyright you own or are authorized to act for, send a written notice to our Designated Copyright Agent (below) that includes all of the following, as required by 17 U.S.C. Section 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  • Identification of the material that is claimed to be infringing and that is to be removed, with enough detail to let us locate it (for example, the Graniite share link URL).
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

When we receive a valid notice, we will act expeditiously to remove or disable access to the identified material and will make a reasonable effort to notify the affected user.

3. Misrepresentations

Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Please be sure your claim is valid before submitting a notice.

4. Counter-notification

If your content was removed or disabled and you believe this was a mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes all of the following, as required by 17 U.S.C. Section 512(g):

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location at which it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Graniite may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat infringers

Graniite maintains and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. An account that is the subject of repeated valid infringement notices may be suspended or terminated.
